Terms of Service

1. Acceptance of these terms

Ordering from Hosting & Domains (“we”, “us”), or using anything supplied by us, amounts to accepting these terms in full. Where you disagree with any part of them, the proper course is not to use the service at all.

2. Pricing, invoicing and renewals

Hosting, VPS and domain services are billed in USD through our billing platform ahead of each service period. Whatever your hosting plan costs at signup is what it costs when it renews. Where a name carries a discounted first year, the renewal figure sits right beside it before checkout, so nothing lands on a later invoice that was not shown up front. An invoice left unpaid past its due date may lead to the service it covers being suspended.

3. Refunds and when they apply

Premium and business hosting plans give you a 30-day window to ask for your hosting fees back. Reseller hosting carries a 7-day window. Domain registrations, VPS and dedicated servers are bought from our upstream providers the moment your order goes in, so once they are live no refund is possible.

4. Acceptable use of the service

You may not use our services to:

  • host or circulate malware, phishing pages or unlawful material;
  • send bulk email nobody asked for — spam, in plain terms;
  • attack, probe or interfere with other networks and systems;
  • take so much of the shared resource that other customers suffer for it.

Breaking these rules may see the account suspended or closed. Where warning you first is practical, we do.

5. Uptime and support

The network is run against a 99.9% uptime target. Should a month land under that figure because something failed on our side, tell us and a pro-rated credit is applied to your account. Our help desk is staffed at every hour and can be reached by ticket.

6. Your content and copies

A daily copy runs as a courtesy. Keeping your own copy of your content stays your responsibility. Our responsibility for lost data does not extend beyond restoring the most recent copy in our possession.

7. Limitation of liability

All services are provided “as is”. To the fullest extent the law permits, total liability on any claim is capped at whatever you paid for the service in question over the three months before it arose.

8. The company you are contracting with

Hosting & Domains is a trading name of UK Health Care Support Ltd, a company registered in England and Wales under company number 15042717, registered office Office 4648, 58 Peregrine Road, Ilford, England, IG6 3SZ. Your contract is with UK Health Care Support Ltd. The filing record is open on the public Companies House register whenever you care to look at it.

9. Governing law and jurisdiction

These terms, together with any dispute or claim arising out of them or their subject matter — non-contractual disputes and claims included — are governed by and construed in accordance with the law of England and Wales. Both parties agree that the courts of England and Wales have exclusive jurisdiction to settle any such dispute or claim.

If you are a consumer, nothing above removes the protection granted to you by the mandatory consumer-protection law of your country of residence, and nothing here restricts your right to bring proceedings in your local courts where that country's law provides for it. Wherever your national law grants rights these terms would otherwise reduce, your national rights prevail.

We sell worldwide. Confirming that buying and using our services is lawful where you are sits with you.

10. Cancellation rights

Consumers in the UK and the EU generally hold a statutory right to cancel a distance contract within 14 days without giving a reason. Our own guarantee is broader: 30 days on hosting plans and 7 days on reseller plans. The broader guarantee does not replace the statutory right — you may rely on whichever serves you better.

One exception is worth putting plainly, because it catches people out time after time. Domain registrations, renewals and transfers cannot be cancelled or refunded once placed, because the registry charges us the moment a name is registered and that cost never comes back. 11. Sales tax, VAT and GST

Figures are shown before any sales tax, VAT or GST that may be due from you. Where we are required to collect tax on your order, it is worked out and shown at checkout before you pay. Outside the UK and the EU, working out and paying whatever your own country levies on a service bought from abroad is your responsibility.

12. Changes to these terms

From time to time these terms are revised. Any change of real substance is sent to you by email or posted in your client area no less than 14 days before it applies. Questions before then go to info@hosting-n-domains.com.
