Terms of Service

1. Acceptance of these terms

Ordering from Hosting & Domains (“we”, “us”), or making use of anything we supply, counts as acceptance of these terms in their entirety. Should you disagree with any part of what follows, the correct course is to leave the service alone.

2. Pricing, invoicing and renewals

Hosting, VPS and domain services are invoiced in USD through our billing platform, in advance of each service period. The figure your hosting plan carries at signup is the figure it carries at renewal. Where a name comes with a discounted first year, the renewal amount is printed alongside it before you reach checkout, so nothing turns up on a later invoice that was never shown to you in advance. Leave an invoice unpaid beyond its due date and the service it covers may be suspended.

3. Refunds, and when you get one

On premium and business hosting plans you have a 30-day window in which to ask for your hosting fees back. Reseller hosting comes with a 7-day window instead. Domain registrations, VPS and dedicated servers are purchased from our upstream providers the instant your order goes in, so once they are live no refund can be made.

4. Using the service acceptably

Our services must never be used to:

• host malware, phishing pages or unlawful material, or pass it on;
• send bulk email that nobody requested, which is to say spam;
• attack other networks and systems, probe them or interfere with them;
• consume so much of the shared resource that other customers are made to suffer.

Break these rules and the account may be suspended or shut down altogether. Where giving warning first is practical, we give it.

5. Uptime and support

We run the network against a 99.9% uptime target. If a month comes in beneath that figure because something on our side failed, say so and a pro-rated credit goes onto your account. The help desk is staffed at every hour of the day, and a ticket is the way to reach it.

6. Your content and copies

The daily copy is run as a courtesy, nothing more. Responsibility for keeping your own copy of your content rests with you. Where data is lost, our obligation goes no further than restoring the most recent copy we happen to hold.

7. Limitation of liability

Every service is supplied “as is”. So far as the law allows, total liability on any claim is limited to whatever you paid for the service concerned during the three months preceding the moment the claim arose.

8. Which company you contract with here

Hosting & Domains is a trading name of Azaanex Inc., which is a corporation holding federal incorporation in Canada under corporation number 1766541-5, registered office 5-145 1/2 Church St, Toronto, Ontario M5B 1Y4, Canada. Your contract is with Azaanex Inc.. Its filing record sits open on the public Corporations Canada register, there to inspect whenever you feel like looking.

9. Governing law and jurisdiction

Any dispute or claim connected with these terms, or with the subject matter they deal in, falls to be settled under a single body of law, contractual or otherwise. Everything here is read and applied under the laws of the Province of Ontario and by the federal laws of Canada that apply within it. Both parties accept that exclusive jurisdiction to settle any such dispute or claim rests with the courts of Ontario.

If you are a consumer, nothing set out above strips away the protection the mandatory consumer-protection law of your country of residence gives you, and nothing here narrows your right to bring proceedings before your local courts where that country's law allows for it. Wherever your national law confers rights that these terms would otherwise cut back, the national rights win.

Our services are sold worldwide. Checking that buying and using them is lawful where you live falls to you.

10. Cancellation rights

A statutory right to cancel a distance contract is normally available to consumers in the UK or the EU, and it runs for 14 days without needing to give a reason. What we offer goes further: 30 days on hosting plans and 7 days on reseller plans. That wider guarantee sits alongside the statutory right rather than replacing it, so rely on whichever of the two serves you better.

There is one exception worth stating plainly, because it trips people up again and again. Once placed, a domain registration, renewal or transfer cannot be cancelled and cannot be refunded, since the registry bills us the moment a name is registered and that money never comes back to us. 11. VAT, GST and sales tax

Prices appear before any sales tax, VAT or GST you may owe. Where we are obliged to collect tax on your order, the amount is calculated and displayed at checkout before payment is taken. Outside the UK and the EU, calculating and paying whatever your own country levies on a service purchased from abroad rests with you.

12. Changes to these terms

These terms get revised now and again. Anything amounting to a substantive change is emailed to you, or posted inside your client area, no fewer than 14 days before it takes effect. Should you have questions before that point, write to info@hosting-n-domains.com.
